CDOT Violations

CDOT violations are initiated by the Chicago Department of Transportation (CDOT). A CDOT inspector who discovers a violation pertaining to the public way will issue your business an Administrative Notice of Ordinance Violation (ANOV). The most common of these violations occur when the street has not been properly asphalted, work is done on the public way without a permit, a dumpster box is placed on the public way without a permit, or the work violates the permit terms and conditions. At these hearings, an Administrative Law Judge (ALJ) will decide, based on the ANOV, whether or not the City has met its prima facie case. If the ANOV both alleges a sufficient factual basis and is filled out correctly, the Owner will be given a chance to explain and defend his or her case. Based on the ANOV and the Owner's presentation, the ALJ will determine whether or not the Owner is liable.
